The collectible rule is the starting point

Federal tax law generally treats investments in collectibles by an IRA as distributions, but IRC Section 408(m) provides exceptions for certain coins and bullion.

Bullion eligibility has conditions

The IRS states that certain gold, silver, platinum and palladium bullion can qualify when it meets the statutory fineness requirements and is kept in physical possession by a bank or approved non-bank trustee. Some specified coins also qualify.

Dealer inventory is not the legal standard

Do not assume a product is IRA-eligible merely because a dealer sells it or describes it as investment-grade. Confirm eligibility with the custodian and applicable IRS rules before purchase.

Personal possession is a separate issue

Directly owned bullion and IRA-owned bullion are not interchangeable structures. Taking possession of IRA property can create distribution consequences, so custody questions should be resolved before a transaction.

  • Identify the dealer, IRA custodian and depository separately.
  • Confirm product eligibility and distribution procedures.
